Patents in India

The blog is about the news that came recently about Patent ruling by Supreme Court on Novartis Patent.
On the outset when one see this ruling it is like destroying the research and development. Ideally this is not a better ruling for research and development.

But this ruling has to be seen in the context of India and its present structure.

This kind of ruling would have not come from the highest court of India if 

  • there is a better health system placed in the country.
  • companies in India follow charity policy as the companies which follow in other countries.
  • the companies in India do not use any of corrupt methods in developing their companies.
  • last but the major one if the politicians are committed for the development of the country.
Since none of the above are happening this kind of tremor will catalyze above things. This is like a bomb what Bhagat Singh tried

This will surely hit the research in India. But should this be seen as hit to research in India ? I believe no because there is a lots of young population coming out colleges. And there is lot of energy in them. And Indian history says that the people who does research are known to be Brahmin (please remember it is not that who are assumed to be offspring of a Brahmin or not real Brahmin). And the very duty of Brahmin is to bestow the knowledge for the development of the society. If this sense is still there in India then this is not a hit to the research and development.

Hope this tremor will above four specified things. And patenting pattern will be stabilize as per the international standards.
